Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Kesu mobile application (“Kesu,” “the App,” “the Service”), published by Apex Crew (“we,” “us,” “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App.

Please also read our Privacy Policy, which forms part of these Terms.

1. The Service

Kesu is a screenshot-management tool for Android. It detects screenshots you capture on your device, lets you assign a deletion timer to each screenshot, and automatically deletes those screenshots from your device when the timer expires. It also maintains a local record of this activity for your reference.

Kesu runs on your device and does not require an account or an internet connection to function.

2. Important notice about automatic deletion

Kesu is designed to delete images from your device. Deletion is permanent and irreversible.

By using Kesu you acknowledge and agree that:

• when a deletion timer expires, or when you delete a screenshot manually, the App will remove that image from your device’s storage;
• deleted screenshots cannot be recovered by us, because Kesu operates entirely on your device and we never receive your images;
• you are solely responsible for reviewing which screenshots are scheduled for deletion and for setting timers appropriately;
• you should back up any screenshot or image you wish to keep before it is deleted.

You use the automatic deletion feature at your own risk. We are not responsible for the loss of any image, information, or data resulting from the App deleting screenshots as you configured it to do.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App you represent that you meet this requirement and that you have the legal capacity to accept these Terms.

4. Licence to use the App

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on a device that you own or control, for your personal, non-commercial use.

This licence does not transfer any ownership rights in the App to you.

5. Your responsibilities

You agree to:

• use the App only for lawful purposes and in accordance with these Terms;
• grant only the device permissions you are comfortable with, understanding that revoking required permissions may prevent the App from working;
• take responsibility for the configuration of your deletion timers and presets;
• maintain your own backups of any data you wish to preserve.

You agree not to:

• use the App to delete, alter, or access images or data that you do not have the right to manage;
• reverse engineer, decompile, or disassemble the App, except to the extent this restriction is prohibited by applicable law;
• copy, modify, distribute, sell, or lease any part of the App;
• attempt to interfere with or disrupt the integrity or security of the App or the device it runs on;
• use the App in any way that violates applicable laws or the rights of others.

6. Permissions

The App requires certain device permissions (such as access to media/photos, notifications, running a foreground service, displaying over other apps, and starting after reboot) in order to detect and delete screenshots. These permissions and the reasons for them are described in our Privacy Policy. You are responsible for granting or revoking these permissions through your device settings.

7. Intellectual property

The App, including its design, code, user interface, name, logo, and all related materials, is owned by Apex Crew and is protected by applicable intellectual property laws. Except for the limited licence granted in Section 4, no rights are granted to you.

“Kesu” and the Apex Crew name and branding may not be used without our prior written permission.

8. No warranty

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• the App will be uninterrupted, timely, secure, or error-free;
• screenshot detection or deletion will occur at an exact time or under all device conditions (device power-saving settings, manufacturer restrictions, storage behaviour, and operating-system changes can affect timing and reliability);
• the App will be compatible with every device or operating-system version.

You acknowledge that background detection and scheduled deletion depend on your device’s operating system and settings, which are outside our control.

9. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Apex Crew, or its owners, employees, or contributors, be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, images, profits, or goodwill, arising out of or in connection with your use of, or inability to use, the App - including any loss resulting from the deletion of screenshots or other images by the App - even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to the App or these Terms shall not exceed the amount you paid for the App (which, for a free app, is zero).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Indemnity

You agree to indemnify and hold harmless Apex Crew and its owners and contributors from any claims, damages, liabilities, and expenses arising out of your misuse of the App or your violation of these Terms or of any applicable law.

11. Third-party services and app stores

The App is distributed through Google Play. Your download and use of the App are also subject to the terms and policies of Google Play. We are not responsible for the app store’s services. Google is not a party to these Terms and is not responsible for the App.

12. Updates and changes to the App

We may release updates, modify features, or discontinue the App (in whole or in part) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

13. Termination

These Terms remain in effect while you use the App. You may terminate them at any time by uninstalling the App. We may suspend or terminate your licence if you breach these Terms. Upon termination, the licence granted to you ends and you must stop using the App. Sections that by their nature should survive termination (including Sections 7 through 10) will survive.

14. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date above and, where appropriate, provide notice within the App or on our website. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

15. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law principles. You agree that the courts located in Pakistan shall have jurisdiction over any dispute arising out of or relating to these Terms or the App, subject to any mandatory consumer-protection rights available to you in your country of residence.

16. Severability and entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Apex Crew regarding the App and supersede any prior agreements.
